In my opinion, people shouldn't be banned merely for spawning this. That's like banning someone for spawning a turret but not firing it. It's silly.
Ban them if they kill with it, but that should be it.
Is it even in the splash screen, not to use it? (I obviously don't know, since I can't see that)

I'll quickly steal his idea and build the same sorta E2, if GMod is working for me. But it seems a bit, er, unstable. If anyone staring at anyone presses E
